KVKK Privacy Notice

This is a courtesy translation. In case of any discrepancy, the Turkish version prevails.
This notice is provided under Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Obligation to Inform, to explain how personal data is processed through the www.zoomkimya.com website.

2. Personal data processed
We only process the data you share with us through the contact form and the quote request form.

The forms do not ask for special categories of personal data (health, biometrics, etc.); please do not include such data.
3. Purposes
- Receiving, assessing and replying to your requests, questions and messages,
- Planning and carrying out product supply, consulting and quotation processes,
- Contacting you about your request,
- Information security, and preventing abuse and spam,
- Providing information to authorities as required by law and protecting our rights in disputes,
- With your explicit consent: measuring how the website is used, understanding which content draws interest and improving the site accordingly.
4. Legal grounds
Your data is processed on the following grounds under KVKK Article 5(2):
- (c) processing is directly related to the establishment or performance of a contract (quotation and consulting requests),
- (ç) processing is necessary for compliance with a legal obligation,
- (e) processing is necessary to establish, exercise or protect a right,
- (f) processing is necessary for our legitimate interests, provided it does not harm your fundamental rights and freedoms (replying to general messages, transaction security).
The checkbox on our forms confirms that you have read this notice; it is not a request for explicit consent.
Analytics data is processed solely on the basis of your explicit consent under KVKK art. 5(1). You may refuse it in the cookie notice, and withdraw it at any time through the “Cookie preferences” link at the bottom of the page; measurement stops immediately.
5. How we collect data
Data is collected electronically when you fill in our forms; IP addresses and access logs are collected automatically by our servers. If you contact us directly by email or phone, the information you share is also covered by this notice.
6. Transfers
Your data is never sold or shared for marketing. It may be transferred only to:
- our website hosting provider, to deliver the service technically,
- our email service provider Google (Google LLC / Google Ireland Ltd.), to deliver form submissions to our team by email. Because this service may use servers outside Türkiye, this is a cross-border transfer carried out under the standard contract safeguard published by the Personal Data Protection Board pursuant to KVKK Article 9,
- competent public authorities and courts when legally required,
- our legal and financial advisers where necessary to establish or protect a right.
7. Retention
Analytics records are kept for at most 12 months and are deleted automatically afterwards.
Form submissions and correspondence are kept for up to 2 years after your request is closed if no business relationship is formed. If one is formed, statutory periods under the Turkish Commercial Code No. 6102 and the Tax Procedure Law No. 213 (generally 10 years) apply. After that, data is deleted, destroyed or anonymised.
8. Your rights
Under KVKK Article 11 you may apply to us to:
- learn whether your personal data is processed,
- request information about the processing,
- learn the purpose of processing and whether data is used accordingly,
- know the third parties in Türkiye or abroad to whom data is transferred,
- request correction of incomplete or inaccurate data,
- request erasure or destruction under the conditions in KVKK Article 7,
- request that corrections, erasure or destruction be notified to third parties who received the data,
- object to a result against you arising exclusively from automated analysis,
- claim compensation for damage caused by unlawful processing.
9. How to apply
Under the Communiqué on the Procedures and Principles of Application to the Data Controller, send your request in writing (in Turkish), stating your full name, signature, Turkish ID number (for foreigners: nationality and passport number), address, email / phone if any, and the subject of your request:
- by a wet-signed letter delivered by hand or through a notary to our address above,
- via registered electronic mail (KEP), secure electronic signature or mobile signature,
- from an email address you have previously given us and that is registered in our systems, to info@zoomkimya.com.
We will respond free of charge within 30 days at the latest; if the request involves an additional cost, the fee set by the Board may be charged. If your request is rejected, the answer is insufficient or not given in time, you may complain to the Personal Data Protection Board under KVKK Article 14.
